Motik Terms of Service
Effective from 29 October 2026. This is an English translation for convenience – the Polish version is legally binding.
§ 1. General information
- Motik, available at https://motik.pl, is a classifieds site for selling passenger cars, SUVs and vans.
- The site is operated by MULTICARS KOMPLEX SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, ul. Zarzecze 74, 24-100 Puławy, Tax ID (NIP) 7162831841, wpisana do rejestru przedsiębiorców KRS pod numerem 0000886609, REGON 388276974, kapitał zakładowy 5 000 zł (the “Operator”).
- Contact the Operator at [email protected]. This address is also the point of contact for users and public authorities under the Digital Services Act (DSA). We communicate in Polish and English.
- Browsing listings is free and requires no account. An account is needed only to post listings.
§ 2. Account
- An account may be created by an adult or a business. You need an e-mail address, which must be confirmed via a link sent by the site.
- The account agreement is concluded for an indefinite period and is free of charge. You can delete your account at any time in the “Account” section – your listings and photos are deleted with it.
- You are responsible for keeping your password confidential. If you forget it, you can set a new one via a link sent to your e-mail.
§ 3. Listings
- A listing may only concern a passenger car, SUV or van that the advertiser has the right to sell.
- The details in a listing (including year, mileage, price and condition) must be true. Photos must show the car being sold and must not infringe the rights of others.
- In particular, the following are prohibited: illegal content, fictitious or misleading offers, cars originating from crime, offensive content, advertising other services and duplicating the same listing.
- A listing is visible for 30 days. Before it ends we send an e-mail reminder; the listing can be extended free of charge with the “Refresh” button. One account may have up to 20 listings.
- By adding photos and a description, the user grants the Operator a free licence to display them on the site (including thumbnails and link previews) for the duration of the listing.
§ 4. Role of the site
- The site provides space for listings (a hosting service). The Operator is not a party to contracts between buyers and sellers and does not inspect cars.
- We recommend viewing the car before buying, checking the VIN and documents, and not paying deposits to strangers.
- Order of listings. By default we show the newest listings first, by date added (extending a listing does not change its position). Buyers can change the sorting (price, mileage, year) and narrow results with filters and search. The order does not depend on any payments – the site offers no paid promotions.
- Business or private seller. Each listing states whether the seller is a business or a private person, based on the seller's declaration in the form. Businesses must mark their listings as “Dealer”. Consumer protection rules do not apply to purchases from private persons.
- Price reductions. When a seller lowers the price, for 30 days after the reduction we show the previous price and the lowest price in the 30 days before the reduction, calculated from the price history stored on the site.
- Voluntary support. Posting and browsing listings is free. Users may voluntarily support the creator of the site via the external service buycoffee.to (“Buy a coffee”). Payments go to the creator of the site (a natural person), not to the Operator. A payment is voluntary, intended for running and developing the site, gives no additional services and does not affect the order or visibility of listings. The payment is handled by an external operator under its own terms.
§ 5. Reporting listings
- Anyone can report a listing using the “Report listing” button on the listing page or by e-mail to [email protected].
- A report should identify the listing, explain why the content is illegal or breaches these terms and – if the reporter wants a reply – include an e-mail address.
- We handle reports without undue delay, usually within 3 business days. If the reporter gave an e-mail address, we inform them of the decision.
§ 6. Moderation and appeals
- The Operator may hide or remove a listing that breaks the law or these terms and, in case of serious or repeated breaches, block the account.
- We inform the user by e-mail about hiding a listing or blocking an account, stating the reason for the decision.
- The user may appeal within 6 months by writing to [email protected]. Appeals are reviewed by a person, not an automated system; we reply within 14 days.
§ 7. Complaints
- Complaints about the operation of the site can be sent to [email protected]. We reply within 14 days.
- Consumers may also use out-of-court dispute resolution, e.g. help from a municipal or district consumer ombudsman (rzecznik konsumentów).
§ 8. Final provisions
- The processing of personal data is described in the Privacy policy.
- We notify registered users of changes to these terms by e-mail at least 14 days before they take effect. Anyone who does not agree may delete their account.
- Matters not covered here are governed by Polish law, including the Civil Code, the Act on Providing Services by Electronic Means and Regulation (EU) 2022/2065 (Digital Services Act).
